Romeo and Juliet Law

Florida has very strict laws with strict and serious punishments when it comes to sex with minors. In 2007, the Florida Senate enacted the Romeo and Juliet law in an effort to address concerns about high school aged kids being labeled as sex offenders or sex predators.

Under Florida Statute 943.04354, this group of sex offenders may petition the court for removal of the registration requirements if they meet certain criteria.

  1. Convicted of a sex offense whether the adjudication was withheld or not
  2. Has no other similar convictions
  3. Not more than 4 years older than the victim
  4. Victim is aged 13 to 17
  5. Registration is required only because of the offense charged and there are no other charges requiring registration

Relief under the Romeo and Juliet law is completely discretionary.  This means that although you may qualify for relief under the law, the judge does not necessarily have to grant it. Pre-trial negotiations are extremely important and it is imperative that you are properly represented throughout the process.
