Domestic Battery by Strangulation

Under Florida Statute 784.041, Domestic Battery by Strangulation is committed when a person knowingly and willingly, against the will of the alleged victim, impedes the normal breathing or circulation of the blood of a family or household member or of a person with whom he or she is in a dating relationship, so as to create a risk of or cause great bodily harm by applying pressure on the throat or neck of the other person by blocking the nose or mouth of the other person.

Domestic battery by strangulation is a felony of the third degree, punishable as provided in Florida Statute 775.082, Florida Statute 775.083, or Florida Statute 775.084.

PENALTY

If you are convicted of Domestic Battery by Strangulation, you are facing up to five (5) years in prison and a $5,000.00 fine. In the state of Florida, it is also mandatory that the defendant complete a Batterer's Intervention Program and financial obligations.
